This Cookies Policy (hereinafter referred to as the “Policy”) provides a clear and comprehensive explanation of how Viabanko s.r.o. , a company incorporated under the laws of the Slovakia, under the Company number 56 700 474 , having its legal and business address at: Malinová 2802/35 Dunajská Lužná 900 42, represented by Chairman of the Board Oleg Vernygora (hereinafter referred to as the “Company”, “We”, or “Us”).
Operating as a digital over-the-counter (“OTC”) asset trading Platform We use cookies and similar tracking technologies to ensure secure functionality, enhance Client experience, monitor Platform activity, and meet legal obligations under:
- Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter referred to as the “GDPR”);
- Directive 2002/58/EC of the European Parliament and of the Council (hereinafter referred to as the “ePrivacy Directive”);
- Act No. 18/2018 Coll. on Personal Data Protection of the Slovak Republic (as amended) (Zákon o ochrane osobných údajov a o zmene a doplnení niektorých zákonov);
- Act No. 452/2021 Coll. on Electronic Communications of the Slovak Republic (Zákon o elektronických komunikáciách).
For the purposes of this Policy, the Platform refers to the technological and communication environment used by the Company to deliver its Services. This includes, without limitation the Platform, any Client dashboards or interfaces (if applicable), communication tools such as Telegram bots or chats, and any other means by which the Company interacts with Clients (hereinafter referred to as the “Platform”).
This Cookies Policy explains how and why We use these technologies and informs you about your rights and options to manage them.
Terms in this Policy are defined in accordance with our OTC Service Terms of Use (Public Offer Agreement), Privacy Policy, and relevant data protection laws.

1. DEFINITION OF COOKIES
1.1. Cookies are small text files that are stored on your device (such as a computer, tablet, or smartphone) when you access our Platform. 1.3. Under Article 55(5) of Act No. 452/2021 Coll. and Article 4(1) of GDPR, any data collected through cookies that can directly or indirectly identify a natural person constitutes personal data and must be handled in accordance with applicable data protection legislation.
1.4. Cookies may only be stored or accessed on your device based on your explicit consent, unless they are strictly necessary for the operation of the Platform, in line with Section 55(5) of Act No. 452/2021 Coll. and Article 5(3) of the ePrivacy Directive.
2. INFORMATION ABOUT COOKIES
2.1. In accordance with Article 5(3) of the ePrivacy Directive, Section 55(5) of Act No. 452/2021 Coll., and Articles 6 and 7 of the GDPR, We categorize cookies used on our Platform as follows:
2.1.1. Strictly Necessary Cookies
These cookies are essential for the operation of our Platform and OTC services. They ensure basic Platform functionality such as secure login, fraud prevention, and order/session continuity. These cookies do not require your consent and are installed automatically.

2.1.2. Functional Cookies

2.1.3. Analytical / Performance Cookies

- Linking Client behavior to affiliate partners or conversion tracking tools.

3. COOKIE MANAGEMENT

5. DATA RETENTION
5.1. We are committed to applying the principles of data minimization, proportionality, and storage limitation when processing any data derived from cookies and similar technologies.
5.2. All cookie data collected via our Platform is retained only for the period strictly necessary to fulfill its intended purpose.
5.3. Types of Retention:
5.3.1 We distinguish between different retention behaviors depending on the cookie’s function and ownership:

6.2. Requests may be submitted to the Company’s designated contact point for data protection matters and will be responded to within one month of receipt, or within an extended period where permitted by law, with clear reasoning provided.
6.3. Right to Rectification
6.3.1. Data subjects may request the correction of inaccurate or incomplete personal data concerning them. Rectification will be carried out without undue delay, provided that the request is verifiable and justified.
6.4. Right to Erasure
6.4.1. Data subjects may request the deletion of their personal data under specific legal grounds, such as:
6.4.2. where the data is no longer necessary for the purposes for which it was collected;
6.4.3. where consent has been withdrawn and there is no other legal basis for processing;
6.4.4. where processing is unlawful;

6.5. Right to Restriction of Processing
6.5.1 Processing may be restricted under certain conditions, such as when the accuracy of the data is contested, the processing is unlawful and the data subject opposes deletion, or pending verification of an objection request.
6.6. Right to Data Portability
6.6.1. Where the legal basis for processing is consent or contract, and the data is processed by automated means, data subjects have the right to receive their personal data in a structured, commonly used, and machine-readable format and to transmit it to another controller without hindrance.
6.7. Right to Object to personal data processing
6.7.1. Data subjects may object to the processing of their data at any time where the processing is based on the legitimate interests of the Company or performed for direct marketing purposes. In such cases, the processing shall cease unless compelling legitimate grounds override the interests of the individual.
6.8. Right of Access to Personal Data
6.8.1. The data subjects have the right to request confirmation as to whether their personal data is being processed by Our Company.
6.8.2. Where processing is confirmed, they are entitled to access that data and receive relevant information, including:
